PhD, MS, CRC, LCHMC, NCC, QS

Prior to becoming a licensed mental health clinician, Dana was a Certified Peer Support Specialist. Her work with clients and her own experiences accessing therapy have informed Dana's focus on protecting clients and their information. After learning about Vanderbilt University Medical Center releasing the full medical records of trans/ non binary clients, Dana realized they wanted to do what they could to keep something similar from happening again. This training is her small contribution to that effort. They hope clinicians of all gender identities learn something new they can apply immediately.

“Together, we can make this field better for both clients and clinicians.”

Course Description: In 2022 Vanderbilt University Medical Center released complete copies of medical records for trans/ non binary (TNB) patients to the state attorney general. These patients included minors between the ages of 16 and 17 years old. The situation led to patients' increased fear that their safety and confidentiality would be at risk. As mental health professionals we have ethical and legal requirements regarding clients' records, which includes diagnoses (ACA Code of Ethics, A.2.b.) and progress notes (ACA B.1.b.; NBCC 18). Ethical considerations from the National Board for Certified Counselors and the American Counseling Association Codes of Ethics are addressed, and recent legislation changes specific to TNB clients will be discussed.

Learning Objectives:

  • Incorporate at least two ethical standards when cautiously soliciting information from trans/ non binary clients, writing notes about trans/ non binary clients, and sharing information about trans/ non binary clients
  • Apply more than three stringent procedures regarding confidentiality for the records of trans/ non binary clients
  • Demonstrate understanding of around six implications regarding diagnosis for trans/ non binary clients
  • Recognize around four ways that current laws and ethical codes shape counselor responsibilities
